Terms of sale

1 | Purpose and seller

These general terms of sale ("Terms") apply to any order placed by an individual or company (the "Player") on the Athena Adventure shop (shop.athena-adventure.fr) or from the game server. The seller is BS Studio, a sole proprietorship (micro-entrepreneur), SIREN 848 574 067 (SIRET 848 574 067 00015), Niort RCS 848 574 067, 2 rue des sources, La Chapelle-Largeau, 79700 Mauléon, France. VAT not applicable, art. 293 B of the French Tax Code. Contact: contact@bs-studio.fr.

Placing an order implies unreserved acceptance of the Terms in force on the date of the order. BS Studio may change them at any time.

2 | Products and services

The shop offers digital content on the server (ranks, cosmetics, pets) and physical products (clothing, merchandise). Each product comes with a description, its price and its period of validity. Unless stated otherwise, digital content is valid for the current season.

Content sold is purely cosmetic and gives no gameplay advantage. No content is awarded randomly in exchange for payment.

3 | Prices

Prices are in euros, without VAT (VAT exemption, art. 293 B of the French Tax Code). The price that applies is the one displayed on the day of the order. Delivery costs for physical products are shown before the order is confirmed. Micropayment methods may be priced higher because of the commission charged by the provider.

4 | Orders

The Player picks an item, fills in the order form, confirms by clicking "Pay", then pays. A confirmation email summarises the order. BS Studio may refuse or cancel an order in case of a previous payment dispute, an abnormal order or a request from an unauthorised third party.

5 | Payment

Payment is made in full at the time of order, by the methods offered during checkout (notably PayPal). Payment data is entered and processed exclusively by the payment provider (PayPal (Europe) S.à r.l. & Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, or any other provider indicated); BS Studio never has access to it. An order is processed only once payment has been received. BS Studio is not liable for a failed validation caused by force majeure or a problem with the provider.

6 | Capacity and minors

The Player declares having the legal capacity to contract. A minor may order only with the authorisation of their legal guardian, who is deemed to have accepted the Terms and validated the purchase. If a purchase was made without authorisation, the guardian may write to contact@bs-studio.fr to request cancellation of the order and removal of the content.

7 | Delivery

Digital content (ranks, cosmetics, pets): granted to the game account given at checkout within 48 hours at most after payment. The Player is responsible for the accuracy of the account given.

Physical products: shipped to the address given within 45 working days at most after payment (manufacturing time included). In case of a delay not caused by force majeure, the consumer may, after a formal notice left unanswered for 7 days, cancel the sale and be refunded (art. L.216-2 of the French Consumer Code). Risk passes on handover of the goods.

8 | Nature of digital content

Season content

Season content remains available until the end of the season, then ends when the server resets, like all player progress. The end of a season is announced at least thirty (30) days in advance on the server and on Discord. Its normal end gives no right to a refund. If a season ends less than three (3) months after a purchase, the unused part is, at the Player's choice, refunded pro rata or credited to the next season.

No monetary value

Ranks, content and virtual currencies have no monetary value, cannot be converted into real money and are not a means of payment.

No resale or transfer

Unless stated otherwise, content is strictly personal: resale, assignment or transfer to another account is prohibited.

Suspension and removal

Access to content may be suspended or removed, without refund and subject to the Player's legal rights, where the measure is justified under the rules and proportionate, in particular in case of a rule violation that led to a ban, fraud or abusive payment dispute, or resale or account sharing. If the server closes permanently, the unused part of time-limited or unexpired season content is refunded pro rata.

9 | Right of withdrawal

A Player who is a consumer has 14 days to withdraw without giving a reason (art. L.221-18 of the French Consumer Code), from receipt of the goods (physical product) or from conclusion of the contract (service). Send the request in writing to contact@bs-studio.fr. For a physical product, the refund is made within 14 days of the goods being returned or proof of their return; return costs are borne by the customer. Personalised or custom-made products are excluded.

For digital content, a Player who wants immediate access ticks, before paying, a dedicated box, separate from acceptance of the Terms, by which they request immediate access to the content before the end of the withdrawal period and acknowledge losing their right of withdrawal once performance begins (art. L.221-28 of the French Consumer Code). This request and the purchase timestamp are kept as proof.

10 | Legal guarantees

The seller remains bound, towards consumers, by the legal guarantee of conformity (art. L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (art. 1641 et seq. of the French Civil Code).

11 | Liability

BS Studio's liability is limited to direct and foreseeable damage and cannot exceed the amount paid for the order concerned, except in case of gross or intentional misconduct, personal injury or contrary legal provision. This limit does not deprive consumers of their legal rights. BS Studio is not liable for Internet disruptions or failures of its providers.

12 | Personal data

Data collected with an order is processed by BS Studio to perform the contract, issue invoices and meet its legal obligations. See the privacy policy and the cookie policy.

13 | Complaints, mediation and governing law

Send any complaint to contact@bs-studio.fr. If you do not receive a satisfactory answer, consumers may use free mediation with CM2C, 49 rue de Ponthieu, 75008 Paris, France — Tel.: +33 1 89 47 00 14 — cm2c.net/declarer-un-litige.php — litiges@cm2c.net.

The Terms are governed by French law. Failing an amicable settlement, disputes with business customers fall under the courts of Niort.
